At its meeting the Middle Smithfield Planning Commission acknowledged a written withdrawal from Marshall Square and discussed outstanding retainer/collection issues; staff advised that refund or collection questions are generally for the Board of Supervisors to resolve. The commission agreed to note the withdrawal in the minutes.
The commission accepted a 90-day extension request from Mount Nebo Apartments LLC, extending review to Nov. 27, and at the same meeting moved to table further action on the Mount Nebo submission because the applicant was not present. Members also moved to table a newly submitted CCP item until the August meeting. On each of these motions the transcript records a voice vote with one member stating opposition.
Transcript notes an outstanding fee amount (cited as $4,685) related to collection for past-due retainer balances on withdrawn plans; staff said collections are a separate administrative matter. The commission did not take a final action on refunds or fee collections.
Next steps: staff will acknowledge the Marshall Square withdrawal in the minutes, record the Mount Nebo extension through Nov. 27, and keep the Mount Nebo and CCP items on the agenda for the August meeting when the applicants may be asked to appear.
