The Calbright Board of Trustees on May 20 adopted resolution 26‑08 to accept an Administrative Law Judge decision that found the district had not established faculty service areas and related procedures required to proceed with lay‑offs of three 3.0 FTE academic employees (student counselors). The resolution rescinds the lay‑off notices sent earlier in March to those three academic employees.
Dan Ojeda explained that all three academic employees requested hearings and participated in the administrative hearing process; the ALJ concluded the district could not proceed with the lay‑offs for those positions because required procedures were not established. "This board resolution 26‑08 adopts the ALJ decision in entirety and rescind[s] the lay‑off notice sent to the 3.0 FTE academic employees," Ojeda said.
Trustee Costa asked whether a separate future item on a general fund transfer was related to this item; staff replied the two items were not related. An anonymous public commenter called for "ramifications for executives at Calbright responsible for seeing the lay‑off process through properly" and said executives "clearly missed steps in the case of faculty lay‑offs."
Trustee Le Grande moved the resolution; Trustee Epstein seconded. The roll call vote was 13 yes, 0 no, and the board adopted resolution 26‑08 to withdraw the lay‑off notices for the three academic employees.
Why it matters: the board's action restores the employment status of three academic counselors who had received lay‑off notices and reflects the ALJ’s finding that procedural steps for faculty lay‑offs were not met.
What’s next: the rescission applies to the three academic employees covered by the ALJ decision; public commenters asked for accountability for the administrative errors that led to the contested notices.
