The developer said that approach is used elsewhere and that splitting responsibilities could save roughly six to nine months and reduce upfront cash-flow burdens by allowing costs to be paid monthly rather than as a single large lump sum.
Councilors and staff discussed escrow deposits, providing pre-construction photos to protect city roads from construction damage, explicit construction-access language in amended agreements, and the process for reviewing audited contractor costs before allowing subsequent sections to proceed. Staff noted the development covers about 235 lots and that earlier feasibility and annexation work had already been done.
No amendment was adopted on May 26; staff will compile comments, consult legal counsel, request additional escrow from the developer for amendment processing, and return with a draft amendment and recommended protections (including road repair and pre-construction documentation) for council consideration at a future meeting.
