The Wareham Zoning Board of Appeals took a series of procedural and final actions on Jan. 28, concluding several agenda items with unanimous or near‑unanimous votes.
Approvals and motions at the meeting included:
- Tropical Smoothie (3923 Wharm Cranberry LLC, 302 Cranberry Highway): The board agreed in principle to a minor modification to omit two landscaped islands that were on earlier approved plans and discussed a recommended bond (estimated around $30,000) to secure incomplete curb, masonry and landscape work. The board voted to grant the minor modification and continued the matter to Feb. 11 for final bond documentation.
- 1073 Main Street (Schoolhouse Works): After the applicant submitted revised site plans and the town peer reviewer issued a follow‑up letter on Jan. 19 confirming comments had been addressed, the board closed the public portion and voted to grant the site‑plan approval subject to standard conditions and required final stamped plans.
- 4 West Street (comprehensive permit): Continued to March 11 to allow peer‑review responses and traffic materials (see separate report).
- Candle Paper Lane (Parcel E): The board voted to uphold the building commissioner's determination that the parcel is not buildable (see separate article).
- Robert Sylvester (50‑25): The board granted a home‑occupation special permit for a small exterior demolition business, with a condition limiting business‑related vehicles to a single truck (no large trailers or conspicuous commercial signage). The condition is intended to limit spillover commercial activity in an R130 residential area.
- Lauren Mahoney (51‑25): The board granted a variance to legalize a 120‑sq‑ft shed that had been installed forward of the principal dwelling due to conservation constraints; the board found the statutory tests for variance were met.
Votes were generally unanimous; when a motion was passed the board recorded 'I' votes from members Troy Larson, Jim Akubachi, Christopher County, Richard Sample and Chair Nazi El Kalasi.
These routine approvals and continuations close certain procedural loops but leave substantial, contested matters (notably the 4 West Street Chapter 40B application) pending further review.
