Committee asks for legal memo after district charges extended temporary-cooler rentals to bond funds

Members of the Citizens Bond Oversight Committee scrutinized the districtdecision to charge extended rentals and some purchased temporary cooling units to bond funds rather than to operating accounts.
Committee Chair Carl Landers noted that the initial rental for temporary units had been paid from operating funds and asked why subsequent rental costs were reclassified to the bond program. Rick (committee member) said the committee had requested "the legal basis by which the decision was made to move the rental expense from an operating expense to a bond expense." Staff responded that district counsel concluded the extension was an allowable ancillary bond expense because the continued rental was required due to bond construction schedule delays.
"The nut of it comes down to ancillary work that the school district would not be required to undertake or to fund but for the existence of the construction project," a staff member summarized when explaining the legal rationale; staff said they will circulate the written legal opinion to the committee.
Committee members also asked about the disposition of units that were purchased for extended use but will become redundant once permanent HVAC is installed. Staff said the contractor will return the roughly "a little bit over a hundred" units, the district will store them temporarily, and it will attempt to resell them to another district; a small number will be retained for emergency use.
The committee asked staff to provide the written legal memo and indicated it expected the resale proceeds or reuse plan to be reported back to the committee as part of the annual report materials.
Next steps: staff to provide the counsel's written legal opinion on allowability and a follow-up report on the resale or reuse of the purchased temporary cooling units.
