The Wareham Planning Board on Jan. 12, 2026 voted unanimously to find that Plan 26‑1 for Gerald V. Robbery is 'Approval Not Required' (ANR) rather than a subdivision and endorsed the verification so the applicant can record the plan.
Christopher Timson, an attorney representing the applicant, told the board the owner had been granted a building permit for an accessory dwelling unit (ADU) but the building department withdrew that permit after finding three lots involved in the proposal needed to be combined under common ownership. Timson said the applicant recorded a plan to combine the lots so the building department could reissue the ADU permit: "the permit was essentially withdrawn by the building department because they said we have three lots here that this ADU sort of relies upon for the um requirements," Timson said.
Board members asked about frontage and access requirements. The board noted the R30 zoning frontage requirement of 150 feet and discussed that the merged parcel meets the ANR criteria for frontage and access; the chair and several members agreed they could find the filing "not a subdivision." After an initial finding the board voted to endorse the ANR verification and indicated members would sign registry‑ready paperwork so the applicant may record the plan. The board recorded the ANR finding and the endorsement by unanimous roll call.
The board clarified that reissuance of the ADU permit is a separate action by the building department and depends on the applicant recording the endorsed plan. No building‑permit reissuance occurred at the meeting; the endorsement authorizes the applicant to proceed with registry recording.
Next step: applicant to record the endorsed ANR verification; once recorded the building department will consider reissuing the ADU permit.
