Weymouth mayor says new MBTA-area housing rules risk eroding local zoning control

“[The law] dramatically takes away local control from communities,” Headin said on Ask the Mayor, describing the Attorney General’s guidance as a “threatening missive” that told municipalities they must comply or risk losing eligibility for certain state grants. He said municipal leaders, including those at the Mass. Municipal Association, view the statute as unclear in key definitions — including how the law defines MBTA communities and what counts as affordable — and expect those issues to be litigated or otherwise clarified.
Headin said Weymouth’s recent commercial-corridor overlay helped the town qualify under the new criteria and has supported redevelopment projects (he cited the Boston motel redevelopment and activity around Colombian/Colomban Square) but warned that some state interpretations would force dense multifamily, low-income housing near rail corridors without guaranteeing ground-floor retail to serve new residents.
The mayor said the town will continue to evaluate the application of the law while state officials, municipal associations, and legal advisers work through guidance and potential challenges. He did not announce any specific local policy change or legal action during the program.
