Dr. Steven Epstein, a member of the Needham Board of Health, had urged the Select Board during public comment to seek a waiver after the state law change. "Limited delivery of recreational marijuana is now permitted in every municipality in Massachusetts by default," he said, and called attention to risks he said are harder to manage through delivery than at regulated retail counters, particularly youth access and inconsistent ID verification.
Town staff explained that Chapter 65 of the Acts of 2026 changed the default for recreational delivery and that municipalities that had previously banned retail can request a waiver; the statute directs the Cannabis Control Commission to grant an initial two‑year waiver upon application. Board members discussed enforcement questions, and the town manager said she would seek clarification from the commission on enforcement mechanics.
After a motion to opt out was made and seconded, the board voted in favor and the motion carried. Staff will file the waiver request with the Cannabis Control Commission and monitor forthcoming state guidance.
