Council forms Community Facilities District for Orchard Park, sets special election

The City Council voted to form Community Facilities District (CFD) 0816 for Track 6614 (Orchard Park) and to call a special landowner election on special taxes to fund operation and maintenance of public improvements in the subdivision. City staff said LGI Homes intends to build 229 homes and that the estimated annual cost to operate and maintain the included public facilities is approximately $126,000—about $553 per lot per year, subject to CPI adjustments up to 4%.

Mr. Gonzalez presented the proposal and explained the CFD functions similarly to existing lighting and landscape districts but is tailored to the subdivision’s maintenance needs. Staff reported that notice of the public hearing had been mailed and published in accordance with law, that no protests or written objections had been received, and that the county registrar certified there are no registered voters in the CFD territory.

Council conducted the public hearing, then moved and approved the resolutions to form CFD 0816, to submit the levy propositions to a special landowner election to be held March 18, 2025 (as presented), and to waive first reading of the implementing ordinance by title only. The clerk reported that the special election ballots were canvassed and that all votes cast were in favor of the measures.

No changes to the proposed tax rate were made on the council floor; staff noted the per-lot figure is subject to change and can be increased annually via CPI adjustments not to exceed 4% per year. Council asked procedural questions about notice and voting eligibility; staff confirmed the schedule and that the CFD boundaries and owner consents were in order. The public hearing concluded with the council’s recorded roll-call votes. The council directed staff to finalize election and ordinance documents for record.
