City legal counsel advised the Environmental Commission on how state hybrid‑meeting guidance and case law affect quorum calculations for the commission.
Anadina Casemnian of the city legal department told commissioners that “quorum is a majority of members of the body,” explaining that this means more than 50% of the number of seats (including vacancies are treated per the legal calculation) and that remote members can count toward quorum. She also said that state hybrid guidelines require at least 50% of the sitting membership be present in person for a hybrid meeting and that the definition of “sitting membership” excludes vacancies.
Commissioners asked for supporting case-law references and requested the legal department to provide the guidance in writing so the commission could apply the rule consistently, especially given the commission’s current vacancies and questions about whether keeping a remote participant could change the in-person threshold.
Legal counsel agreed to follow up in writing and to provide case-law citations on the point.
The clarification prompted discussion among commissioners about whether the rules incentivize remote attendance when vacancies are numerous; staff and legal said they would provide a written memo and references.
