During arraignment and plea proceedings the court confirmed Reyes and counsel had reviewed discovery and that Reyes knowingly and voluntarily waived his right to a jury trial. The court accepted the state's exhibits and stipulations in lieu of live testimony and found sufficient evidence to enter a guilty finding on count one, paragraph B.
On sentencing the court imposed a 10-year term and ordered credit for any time served. The judge said a referral to a therapeutic community would be made to assist with mental-health issues, noting the court lacks jurisdiction to compel placement; participation would require the defendant to request entry into the program.
The court ordered no residence in households with minors and no unsupervised contact with minors, issued a no-contact order with the complainant and reiterated that, because Reyes waived appeal rights as part of the plea, he lacks the court's permission to appeal. The judge also reminded Reyes that felony convictions with the plea parameters prohibit ownership or possession of weapons or ammunition.
