A minor subdivision proposal for a Buy Road lot was presented Aug. 14, but the Planning Commission declined to act until the applicant obtains required zoning variances.
Engineer Chris Yawn explained the subdivision would create a vacant lot on the south side of the property while retaining an existing house on the north side. The existing house sits closer than current sideyard and aggregate setback requirements and the home’s pool is about 8.5 feet from the property line where code requires 10 feet — each condition requires relief from the zoning hearing board if the owner wishes to preserve existing features.
Commissioners said they do not typically grant conditional subdivision approval that depends on pending variances and asked the applicant to take the zoning hearing board route first. At the meeting a nearby neighbor said residents may purchase the new lot to preserve it as open space; commissioners noted that if ownership is consolidated later, a lot consolidation application could address accessory‑structure issues (for example, preserving a detached garage). Residents also raised sight‑distance and subsurface concerns; one neighbor described a prior sinkhole on an adjacent property and urged careful subsurface investigation.
The commission advised the applicants to pursue variances, coordinate title/deed research for any historical deed restrictions, and return with approvals or a combined lot consolidation if neighbors proceed with a purchase. No vote was taken.
