Council reviews proposal to delay UDO effective date amid state "downzoning" changes

Daniel said the amendment is "really more of a housekeeping action" tied to the downzoning statutes approved by the North Carolina General Assembly in December 2024 and would give state lawmakers time to reauthorize municipal downzoning authority before the UDO's new effective date. The planning board rendered a favorable recommendation and the accompanying consistency statement was presented to council for consideration.
Council members asked procedural questions about how the extension would affect developers' ability to choose which set of rules to follow for new projects. Daniel explained that, while the prior zoning ordinances remain in effect for existing properties, the extension preserves a temporary window during which applicants may choose to proceed under either the legacy ordinances or the UDO, provided they notify the town in writing before development review.
The proposal as presented did not include a final council vote at this meeting; council members asked staff to keep the item on the agenda for the scheduled public hearing and additional review. The public hearing remains scheduled as part of the council's packet and will be revisited in open session with required public notice.
