Wetlands agent issues Cease and Correct for debris at 37 Notch Road; owner disputes order

Wetlands Agent Alyssa Barroso told the Bolton Inland Wetlands Commission on Jan. 28 that she determined on Jan. 13, 2025, that regulated activities were occurring without a permit at 37 Notch Road and that logs, wood chips and other debris were deposited adjacent to and within known wetlands. The commission heard that a previous Notice of Violation had been issued on April 12, 2019, for similar activity.
Barroso said the property owner and tenant are aware that a permit is required for regulated activities but continued the activities; she ordered the property owner to cease depositing material in the wetlands and to remove all debris. Alternate Member Diane DeNunzio recused from the discussion because she lives near the property.
Owner/tenant Alex Ouzonov told the commission he had removed debris and wood chips after the earlier order and challenged the current Cease and Correct. Barroso recommended that Ouzonov hire a soil scientist to determine whether material remains within the wetlands; she said she will work with him to resolve the issue and bring the property into compliance with the order.
The commission did not take a formal vote on enforcement at the Jan. 28 meeting; Barroso will continue follow-up with the property owner to clarify the extent of material in the regulated area and next steps to achieve compliance. The commission recorded the Jan. 13 site determination and referenced the April 12, 2019 Notice of Violation as background.
