Palmetto Bay approves vacation of never-built right-of-way at 15560 SW 67th Court

The Village Council voted March 16 to vacate a right-of-way identified on an historic plat near Dearing Estate and revert it to the adjacent property owner, the Richard Mixon Revocable Trust. Staff research found the right-of-way—originally dedicated for a future 156th Street on an 1899 plat—was never constructed or maintained for public use, and public works had no record of upkeep.
Planning staff and Director Torres described the legal history and supporting documents; staff recommended vacating the parcel and returning it to the adjacent owner. A public comment filed by Juan Allayio supported the vacation, and neighbors including Kyle Mixon (son of the applicants), David McDonald and Eric Davis testified in support, saying the segment has not been used for public traffic for generations and that there are no utilities in the immediate area.
The council approved the resolution to vacate the right-of-way by unanimous roll call (4-0). Staff noted that because of deed and title history, the parcel reverts to the original adjacent owner rather than splitting to neighboring parcels. There were no objections from public works or identified utilities; staff reported no utility easements affecting the strip.
