Planning commission recommends vacation of short Peek Street segment, conditions easement recording

Planning manager Mr. Hart presented a request from Jones Garden LLC to vacate a 0.173-acre undeveloped portion of Peek Street (formerly Virginia Avenue) during the Jan. 15 Planning Commission meeting, explaining the segment was once a public street and currently contains public utilities that must be protected.
Staff said the segment will never be needed again for a public street alignment, but noted multiple public utilities lie in the right-of-way. Mr. Hart recommended that, before the city council considers the ordinance to vacate the right-of-way, recorded easement dedications for utilities be drawn and reviewed by staff so utilities remain protected following the vacation.
No members of the public spoke during the hearing. Commissioners discussed whether to wait for the deed and easement exhibits; staff said the easements could be worked out with the applicant and recommended the commission forward a conditional approval. A commissioner moved to recommend approval on the basis of public necessity, convenience and good zoning practice, with the condition that staff review and approve recorded easement documents prior to council placement. The motion passed on a roll call.
The commission's recommendation will be transmitted to city council; staff advised that the item should not be placed on a council agenda until the easement documents have been drafted and reviewed by planning staff.
