Petition filed to dissolve Union Vale library; board presented legal steps under state law

A petition seeking dissolution of the Union Vale library was presented to the Town Board on Nov. 6, and the clerk read the filing and its legal consequences under state law.

The presenter told the board that voters had been asked to weigh in on a proposition regarding continued municipal operation of the library and that, when tabulated, residents had voted approximately two to one against the town continuing to operate the library. The petition that resulted carried 556 qualified voter signatures, exceeding the 270 required by law, and was filed pursuant to subsection 268 of New York State Education Law.

The presenter said the petition sets forth a binding abolition proposal under that statute and described the statutory procedure: if validated, trustees must transfer to the regents or other libraries property equal in value to any sums the library received from the state or other public gifts used for public library use, and then petition for a certificate of dissolution. The town clerk provided copies of the petition, the clerk’s certification of the signatures, and the text of subsection 268 to board members.

Amy Watkins, identified in the meeting as a library trustee president, was referenced earlier in the meeting for outreach and a public forum; trustees will be part of the procedural steps required if the petition is certified and remains valid.

No board vote was taken Nov. 6 on library abolition itself; the presentation of the petition and accompanying legal materials were entered into the record and distributed to the board.
