Town attorney Dustin Hulesen told the board the statute (recorded in the packet as IC code 5 141.5-3.5D) requires governing bodies to adopt written procedures for electronic participation. "You have to see the person on the screen, they have to see you, you have to hear them," Hulesen said, summarizing the practical standards the board should require to ensure remote participants can be seen and heard by the public.
Board members asked whether a smartphone FaceTime-style connection would meet the visibility requirement; Hulesen recommended routing remote participants to a room display so the entire audience can see them. With that clarification, a board member moved to adopt the town's 2021 resolution; the motion carried by voice vote.
The board left open the option to draft a bespoke policy later but accepted the town's resolution as meeting the statutory requirements. The Chair said staff will finalize the paperwork and implement the procedures for future meetings where remote participation occurs.
