Planning and code enforcement staff (Mr. Patterson) told the council the property has accumulated trash and contains an occupied, dilapidated structure; city utilities are disconnected and Xcel Energy has cut service to the pole. Records list Greg A. Markham as the owner, and code enforcement sent certified notices of violations beginning March 20, 2025. Staff provided photographs taken the day of the meeting and recommended the resolution.
Staff explained that condemnation procedures requiring interior inspection have been delayed because the owner has refused access, so the city must pursue a separate legal process (municipal court or higher court) to resolve conditions inside the structure. Council members described community frustration with the property, asked about health hazards and expedited options, and staff said the lack of utilities provides additional enforcement avenues under the property maintenance code. The council voted to adopt the resolution; staff said it is intended to clean and secure the property and that additional legal steps will follow if necessary.
