Buckingham board approves McIntyre minor subdivision with waivers and stormwater conditions

The Buckingham Township board on June 26 approved preliminary-final approval of the McIntyre minor subdivision, a two-lot lot-line change that transfers roughly three acres from one parcel to another on Lower Mountain Road.
The project was presented by John Genovisi of Tri State Engineers and Land Surveyors. “The parcel to be transferred would be used as pasture for Mr. McIntyre's steer,” Genovisi said, adding the proposal includes no site improvements beyond some clearing and dead-tree removal. He told the board several waivers were requested and that the township engineer supports the waivers.
The approval is conditioned on the applicant’s compliance with the most recent engineering review and the grant of the requested waivers. The transcript records a waiver request letter dated May 22, 2024, and an engineering review letter dated June 21, 2024; the plan revision cited in the meeting was dated May 17, 2024. The board recorded a 90-day review period with an expiration date noted as July 2, 2024.
A Bucks County Planning reviewer said the county’s only open question concerned the proposed principal use; applicants clarified at the planning commission meeting that although the transferred land is intended for a small number of steer, the principal use of the property is single-family detached residential, which satisfied the county’s comment. Carol, who reported visiting the property with the applicant’s representative, said she saw “a pretty sizable area [of] dead ash trees” and described protections for remaining large trees, including possibly split-rail fencing to protect trunks.
Board members moved and approved the preliminary-final subdivision subject to the stated conditions. The motion cites township file ESS 2024 D1 and referenced tax map parcels (from tax map parcel 6-17-20 to 6-17-29). The board’s approval followed the explicit caveat that deferred stormwater and erosion-control requirements would be required if future improvements are proposed.
Next steps: the applicant must satisfy the outstanding engineering review comments and the township must record the granted waivers; any future construction would trigger standard stormwater and erosion-control reviews.
