Committee members and staff discussed voting procedures May 12 after an earlier 3–2 committee vote on the Greensboro Village PMDP raised questions about whether the city charter requires a majority of the full membership or a majority of members present to adopt ordinances and resolutions.
A staff official (who oversees risk management and the records process) told the committee that the charter’s phrasing has been interpreted historically in Gallatin to require a majority of council members present to pass measures, and that the city recorder confirmed that practice. However, the official said she reviewed the language and found alternate interpretations and recommended clarifying charter language to remove ambiguity.
Out of caution and to avoid legal challenges to recent votes, staff recommended re-noticing the Greensboro Village PMDP process and sending a charter-clarifying ordinance to the legislature for amendment. The committee voted to send the drafted ordinance to full council and to re-notice the previously approved PMDP so the full council can consider the item with clear procedural footing.
Council members discussed interim measures (using voting paddles and voice votes in the short term and pursuing an electronic voting system) and asked that staff bring a corrected ordinance and re-notice materials for nearby property owners if the PMDP is reheard.
Next steps: staff will forward the charter-clarifying ordinance to the council and re-notice the Greensboro Village PMDP for a full public hearing and formal readings.
