Auditor Lisa Smith asked the Jackson County Board of Supervisors to consider a waiver of the county’s right of first refusal for a sale of property at 140 Jacobson Drive to Lightfoot Investments LLC. Board members raised concerns that the draft in front of them would broadly release the county’s rights and preferred language that would limit any waiver to the present transaction and price.
Members agreed they needed the county attorney to prepare a tailored document. The board moved to instruct the county attorney’s office to prepare a waiver of the right of first refusal limited to the current offer and authorized the chair to sign the finalized document once the county attorney prepared it. The motion passed by voice vote.
Supervisors said they wanted the document to make clear it applied only to the current transaction, would reference the buyer and the closing date, and would not constitute a blanket waiver of the county’s rights under the original first-refusal agreement.
