The Duxbury Planning Board spent much of its meeting discussing a long-running effort to recodify the town zoning bylaw, focusing on whether definitions should be centralized and whether defined terms should appear italicized in the working draft.
Former planning board member Scott Casagney, who remains active on the zoning recodification working group, gave the board a history of the project and the group’s goals. “The recification isn't a rewrite of the entire bylaw. It's a reorganization of the bylaw with some things that are definitely minor changes,” Casagney said, explaining the effort aims to restore a use chart, consolidate definitions and make the code searchable in the General Code platform.
Board members debated two related choices: pulling all definitions to the front of the document so a term appears once, and using italics in the body to signal defined terms. Supporters said a consolidated definition section and visible cues would make the bylaw easier to use; others, including staff and the General Code representative, warned italicizing every occurrence could produce maintenance burden and confusion and would force repeated edits whenever new sections are added.
At the meeting Tag Carpenter moved that the planning board “direct the ZBRC to remove the italicization of the defined terms.” The motion was seconded and put to a roll-call vote. The transcript records the motion, second and a roll-call sequence, but does not include a full roll-call tally in the public transcript; staff confirmed the vote was taken and the board moved to record their decision in the minutes.
Beyond format, members discussed how to present the recodification and related warrant articles at town meeting without triggering an expansive Attorney General review. Town counsel advised the board that a complete delete-and-replace recodification can prompt a comprehensive AG review; the board asked staff to consult the AG’s Municipal Law Unit and General Code to determine whether a staged approach or a different article format could reduce risk while keeping the schedule for the spring town meeting.
Next steps: staff will request clearer redlines from MAPC and General Code, consult the AG’s office about how recodification would be reviewed, and prepare warrant drafts for the board’s January deadlines. Casagney told the board his working group remains available for questions as the board finalizes text.
