The Berea Planning Commission on Aug. 12 approved a waiver request that allows a one-lot subdivision at 463 South Dogwood Drive despite a title transfer within the past five years.
A planner read the ordinance language that normally requires 50 feet of road frontage but exempts a single additional lot if it has legally enforceable ingress and egress and the original parcel has not been subdivided or had its title transferred in the previous five years. The applicant sought a waiver of the five-year title-transfer restriction, sometimes referred to in discussion as the “family farm” rule.
Jay Webb of Central Kentucky Land Survey told commissioners the proposal is to divide an approximately 1-acre property containing an existing house; three sisters currently own the parcel and one son wants to buy the house separately. Webb said there is an existing 20-foot access easement that will be extended by less than 100 feet to serve the new lot.
Commissioners clarified that the access road is a private drive and that the division is not close to Dogwood Drive. After questions, a commissioner moved to approve the waiver request for 463 South Dogwood Drive; another seconded. The commission approved the motion by voice vote with no recorded opposition, and the chair declared the motion carried.
The applicant thanked the commission and the hearing moved on to staff updates. There was no roll-call vote recorded in the transcript; the approval was taken by voice vote.
