Tenant departure and Open Space questions shadow planned sale of 14 Marple Lane

Craig McAnally told the committee that recording for 14 Marple Lane with the County has not yet occurred and that the property’s tenant plans to vacate Sept. 30, which would make interior inspections and showings easier.
Committee members pressed whether Open Space Fund dollars were used to purchase parts of the property and whether that would trigger special restrictions on sale. Debra Harris asked specifically about Act 153 and whether land purchased with Open Space funds could later be sold only with a public referendum; she said, “if it was purchased with Open Space… we should make sure that we have a good assessment of the property when the easement is written” to enable future inspection and enforcement.
Sydelle Zove recounted asking the Board of Supervisors previously and said Mr. Kilkenny had volunteered at that meeting that Open Space funds were NOT used for Marple Lane. Sydelle then clarified her understanding: that the Karabots’ contribution funded parts and that Marple Lane and the homes and the eight acres of open space were funded by the Open Space Fund, and that an easement would not necessarily be recorded. An engineer present was reported to have shown the wetland delineation and protective buffer on the recorded subdivision plan.
Craig said the engineer had inspected the site and documented the conditions, and that any future building permits or improvements would trigger Township and engineer oversight. The committee agreed to clarify fund sources and easement language before advancing any sale or listing activity.
