The Allenstown Zoning Board of Appeals on Dec. 16, 2025 voted to grant a variance for property ID 10106.018.001, allowing the applicant associated with Allenstown Aggregate and Recycling LLC to proceed with the same proposal that the board approved in October 2023. The board accepted the application as complete and approved the required five variance criteria before voting to grant the variance.
Joseph Dufo, who identified himself as director of real estate for Tivo Corporation and a representative connected with Allenstown Aggregate and Recycling LLC, told the board the new filing is identical to the prior application. "To the best of my knowledge, no difference between the application of that from back a couple years ago," Dufo said, explaining the applicant failed to pull the original permit within the allowed timeline.
A board member moved to accept the application as complete; the motion was seconded and the board voted in favor. The board then moved into deliberation and approved a motion to accept all five variance criteria in a single motion, citing the same information the board reviewed two years earlier. The chair announced the variance had been granted and advised the applicants not to let the permit lapse again.
A board member noted a letter on file authorizing specific representatives to appear for the applicant; the chair identified Ernest J. Thibault as the managing member of Allenstown Aggregate and Recycling LLC as the source of that authorization. The board confirmed the drawings on file (dated 2022) are the same as those in the prior approval.
The chair outlined next steps: staff will prepare and sign the paperwork, file it with the state and mail the decision to the applicant; the decision is subject to the statutory appeal period before planning-board review. The chair said the earliest opportunity to return to the planning board will be the second meeting after the appeal period.
The session also included routine business: the board approved prior meeting minutes and adjourned at about 6:15 p.m. The board recorded no in-meeting opposition to the application.
