The Zoning Commission voted to recommend denial of a rezoning request on the 3200 block of South Foster Road after staff concluded that C3 commercial zoning with a conditional use for oversized-vehicle storage would be incompatible with adjacent single-family parcels.
Staff told commissioners the property sits at the entrance to a residential neighborhood and that industrial uses were concentrated on the opposite side of US Highway 87; staff recommended denial because the requested commercial intensity would create potential nuisances for nearby homes.
The applicant'9s representative, Marty Morales, said the property currently stores semitrailers and that the owner had cleaned and gated the site. Neighbor Jane Shafer told the commission she owns adjacent land and characterized the request as spot zoning that would legitimize ongoing violations. "This zoning request seeks to legitimize the owner's violation," she said, noting a pending UDC violation filed in 2024 and corrugated-metal fencing that the speaker described as another violation.
Commissioners asked about annexation dates, platting and open cases; staff said the lot is unplatted and that active code cases remain. After deliberation, Commissioner Loesseff moved to deny the rezoning; the motion was seconded and carried on roll call.
