Council approves home-based notary at 2001 Parker Street with one-customer limit and ADA requirement

Applicant Anthony Pettigrew told the council he intends to use the property primarily for process serving and notary work and said many service calls happen offsite. "I would like to utilize the property to do process serving and notary service," Pettigrew said, adding that most process-server work is performed in the field.
Council members expressed concern about customers visiting the residence and potential traffic and parking effects in the R3 neighborhood. Council member Robinson noted the city ordinance limits customer traffic for home-based businesses and said allowing customer visits could set a precedent. Planning staff confirmed that a "home occupation" allowing customer traffic triggers building and accessibility standards that a pure "home occupation" without customer visits would not.
After discussion, Council Member Hamilton proposed and the council adopted an amendment restricting "no more than one customer at a time." The council also required that restroom and entrance facilities be brought up to commercial/ADA standards if customers visit the site; city staff will inspect compliance once the applicant has obtained his business license. Pettigrew acknowledged the requirement and said he would work with staff to meet the stipulations.
The motion to adopt the amended ordinance carried on recorded voice votes by council members present. The requirement for ADA-accessible restroom upgrades and inspection was emphasized during the vote and will be enforced as part of the permit conditions.
The city clerk and planning staff will follow up with the applicant on the technical steps needed to implement the permit and the city’s inspection schedule.
