Bureau reports finalized rules on unapproved activity and updates on sunset bill AB 2771

Regulatory staff told the May 26 advisory committee that the bureau finalized regulations clarifying administrative fines for institutions operating without bureau approval (Title 5, sections 75020 and 75030), effective July 1, 2026.
Parker Strommyer, regulation specialist, said the bureau is also preparing a regulatory housekeeping package to update cross-references to Business and Professions Code section 480.2 (which preserves the bureau's authority to consider convictions beyond the seven-year window created by AB 238) and is developing other packages (catalog requirements, minimum operating financial standards, and approval by means of accreditation).
On the legislative front, legislative project manager Ryan Tatcher summarized sunset-review activity. The bureau submitted its sunset report and answered questions in a multicommittee hearing in March. The bureau's sunset bill, AB 2771, carries many changes recommended in the sunset report and was in Assembly Appropriations at the time of the meeting. Tatcher said fee provisions remain under active discussion and could be added to the bill as it moves through the legislative process.
Committee members provided feedback on a proposal to allow certain reduced-credit bachelor's programs at accredited institutions: members urged guardrails, recommended limiting early authorization to accredited institutions, requiring clear disclosure to students, and ensuring that any program that purports to lead to professional licensure meet applicable licensing requirements.
The committee did not adopt regulatory changes at this meeting; staff sought member feedback to inform next steps.
