The Boone County BCA approved permit 26 J14-08, granting a variance to allow an accessory structure larger in height and size than the primary dwelling on property at 9605 West 100 South in Jamestown, Jefferson Township.
Staff described the proposal as a 50-foot by 40-foot barn with an 8-foot covered porch to be used for storage and recreational space. The technical advisory committee flagged several permitting requirements: a septic permit from the health department, a drainage permit from the surveyor's office, a highway driveway permit during construction, and a required firewall separating the garage and recreational area; the recreational space must meet the 2020 energy code. Staff recommended approval with conditions, including that the owner complete a use affidavit recorded with the deed stating the structure shall not be used as an accessory dwelling unit or sleeping quarters unless the owner receives a special exception.
During board questions the petitioner (identified as Todd Fer) confirmed the structure would include a kitchen and bathroom. The chair and board members noted that having plumbing increases the need to ensure the use affidavit and permitting conditions are enforced.
