Planning board schedules Feb. 10 public hearing on shoreland and recording-rule edits

The Poland Planning Board reviewed and forwarded proposed ordinance edits at its Jan. 27 meeting and scheduled a public hearing for 6:30 p.m. on Feb. 10 to take public comment and consider the changes.
Staff explained three principal edits under consideration:
• Remove a fixed paper-weight/color specification for recorded plans (the current draft cited a specific paper weight) and replace it with a general instruction that recorded plans should be submitted "as required by the county registry of deeds," to avoid having to revisit the code for registry-format changes.
• Add a definition for fabric-covered shelters and, outside the shoreland zone, remove a separate permitting requirement so those structures would only need to meet setback and lot-coverage rules unless they are sited in regulated shoreland areas.
• Clarify 'greatest practical extent' language used to evaluate shoreline setbacks by adding 'relocate, reconstruct or expand' to the standard, which staff said would allow the board to better consider waiver requests on steep lots where moving a structure is not practical.
Staff said the department(s) responsible for shoreland review will be asked to review the draft language before the Feb. 10 hearing. A board member asked whether the change would take effect immediately; staff clarified that ordinance changes must be approved at the town meeting (scheduled in June), and if adopted would take effect on July 1 following town meeting approval.
The board authorized formal language to be published for the Feb. 10 public hearing and directed staff to circulate materials and solicit departmental review prior to the hearing.
