The planning commission on May 5 recommended that the Board of Supervisors approve R-26-011 with two conditions aimed at addressing neighbor concerns.
The applicant, Leon Hall, sought to rezone a parcel on State Road 666 (Banister district) from R1 to A1 to allow agricultural uses. Neighbors raised procedural and enforcement concerns in public comment: Emily Ragsdale told the commission the application should have been a special-use permit and pointed out that no well or septic permits or a SAT (site assessment test) had been submitted. "If it's rezoned, there is nothing that says he has to live on this property," Ragsdale said, adding that without an on-site resident animals and odors could create problems.
Hall said he met with neighbors, offered to live on the property within a year and to maintain a trim/tree line or fence. The county attorney and staff advised that proffers must be submitted in writing to be binding; verbal offers can inform a recommendation but must be submitted in writing to be enforceable at the Board of Supervisors stage. Miss Henderson moved to recommend approval with the two conditions (tree-line/fence maintenance and a residence on site within 6–12 months) and the motion carried 4–1.
The commission’s action forwards the rezoning recommendation and the stated conditions to the Board of Supervisors, which has discretion to accept, modify or reject the recommended proffers.
