John Yanceto, an architect representing the property owner, presented an application for interior alterations and continued Gelato Cafe use at 288 White Plains Road and provided proposed hours of operation and zoning context.
"The proposed hours of operations ... Monday through Thursday 7:00 a.m. to 10:00 p.m.; Fridays 7:00 a.m. to 12 a.m.; Saturdays 8:00 a.m. to 12 a.m. and Sundays 8:00 a.m. to 10:00 p.m.," Yanceto said, noting the applicant reviewed the town zoning code with the building inspector and that the use is classified as retail, not a food service that would require a special use permit.
Town counsel reminded the board that, if a variance is granted for this use, the board can condition the approval so the variance applies only to this retail (gelato cafe) use; a conversion to a full kitchen food service establishment would require separate approvals (planning board review and, if applicable, a special use permit). No members of the public asked to be heard on the item.
After brief board remarks that the application met the five‑part variance test, the board closed the public hearing and moved to adjourn the item for a resolution decision at the next meeting.
