Donald said he paid his fare, was seated and that the driver "ran straight across, hit the medium with both wheels" causing a violent jolt that later produced MRI findings and an epidural injection for pain. He told the council his blood sugar has stayed above 200 since the incident and said he has medical records documenting the injury. "I feel like I should be compensated for all that," Donald said.
Council members responded that the council is not a court of law and that determinations of damages and medical causation are outside the council's role; they advised Donald to consult the city attorney and seek legal advice. The council subsequently approved the report of new and pending claims as part of agenda item 5A by unanimous roll call; no council discussion indicated acceptance or denial of this individual claim at the meeting.
