Council reviews revised riverfront license to clarify Sloop Club responsibilities; seasonal users not treated as sublicensees

Council members reviewed a revised license agreement for riverfront dock operations that clarifies management responsibilities and removes seasonal users from a sublicensee designation.

Ken Dow, counsel to the council, and council staff explained that the revised redline makes explicit what the Sloop Club will do as licensee and avoids making seasonal users legally responsible under the city's license. "The license agreement had been extremely vague on that," Dow said, describing edits to clarify what dock management will entail and to capture how seasonal arrangements have worked in practice.

Council members and public commenters representing dock stakeholders urged clearer language on insurance and a one-year versus three-year term; Dow said those technical issues would be reconciled. One public commenter asked whether seasonal users would be expected to collect fees; counsel answered that no party other than the Sloop Club would have obligations to handle money or enforce docking, and suggested adding an explicit line that no other party has obligations "whatsoever."

Council members also discussed separating agreements so the Sloop Club and the Hudson ferry have distinct arrangements, and confirmed that the mayor would sign the main license and approve seasonal arrangements negotiated with the Sloop Club. Council President Morris said staff aimed to have a final document by the following week for council review.

Next steps: finalize insurance and term-language in the redline and return the revised license for council action at a subsequent meeting.
