Residents at the June 24 meeting pressed the commissioners over the Bancroft redevelopment, asking whether traffic and student parking would be displaced and urging preservation of open space. The Borough Solicitor said the Conditional Redeveloper Agreement for Bancroft is signed and the borough is in the 120-day due-diligence period.
Several commenters questioned both the process and the fact that the Commissioner vacancy left only two voting members on some decisions. The Solicitor confirmed that the remaining commissioners could appoint a third member within 30 days under state statute but said the current commissioners do not intend to fill the vacancy before the November special election.
Commissioner Troy and Mayor Bianco Bezich moved to go into closed session at 9:47 p.m. to discuss Bancroft contract negotiations, potential litigation and the status of other lawsuits. The meeting returned from closed session at 11:10 p.m. and adjourned.
Residents were told that legal questions about the validity of votes cast while a seat is vacant would ultimately be for a court to decide if challenged; the Solicitor said there is a presumption of validity at the time a vote is cast but a judge would rule on any dispute.
