Community Development Director Eric Baker presented a comprehensive update to Gig Harbor’s critical‑areas regulations at the Feb. 26 study session, describing proposed changes to protections for wetlands, streams, fish and wildlife habitat areas, steep slopes, flood hazard areas and critical aquifer recharge zones.
"We are responsible for updating our critical areas regulations every 10 years," Baker said, noting the city’s statutory obligation to revisit the code and to base changes on best‑available science. He said the draft relies on state and regional scientific reviews and on gap analyses from an environmental consultant retained by the city.
Baker explained that wetlands and streams are being reclassified in some cases and that buffer widths would change to reflect new science and function. He described an example in which some high‑value wetlands would move to a single 250‑foot baseline buffer, and said forested wetlands adjacent to high‑intensity development could have buffers as large as 300 feet; other categories would see smaller changes. Baker also said protections for non‑fish streams are increasing, including a new minimum buffer (he cited 100 feet as a lower bound in many cases).
The director walked council members through flexibility mechanisms in the draft code: site‑specific analysis by licensed professionals, buffer averaging, buffer reductions supported by habitat management plans, mitigation sequencing (avoid, minimize, mitigate) and the limited use of variance and reasonable‑use exceptions for parcels fully constrained by buffers. Baker emphasized that the city cannot simply prohibit all development on private land without triggering constitutional takings concerns and that the code includes pathways for reasonable use while seeking to achieve "no net loss" of wetland and stream functions.
Baker also addressed process and timing: the draft is out for public comment, planning‑commission hearings are scheduled, staff will email the council a calculated estimate of land area affected by the proposed buffers, and a Harbor Atlas layer showing proposed buffers will be published to allow residents to check their property.
Why it matters: Proposed buffer changes would affect development feasibility on properties near wetlands and streams, influence site design and may affect land values. The code updates respond to the state Growth Management Act requirement to use best‑available science and to limit net loss of ecological function.
Next steps: Staff will accept public testimony, make draft edits, present recommendations to the planning commission, and forward a planning‑commission recommendation to council for formal action in the spring/early summer.
