Vienna planning board approves special-use permit for landscaping retail at 7440 Higginsville Rd

On April 30, 2025, the Town of Vienna Planning Board voted unanimously to approve Special Use Permit SUP2025-02, submitted by applicant James Dibble, to add retail sales and service of landscaping materials at 7440 Higginsville Road in the WR zoning district. Board member Mike Piper moved to approve the permit with the condition that all fertilizer materials be stored indoors; Bill Shaughnessy seconded the motion.
The board recorded a poll vote of five Ayes: Interim Chairman Orrin MacMurray, Bill Shaughnessy, Martha Link, Mike Piper and Dave Carpenter; two vacancies were noted as n/a. The motion carried. The permit application lists the parcel as 237.000-1-48.1 (9.4 acres). The board noted Oneida County DPW and the Town of Verona had until April 21 to respond to the Town’s 239-m referral; no responses were received.
Secretary Kathy Pavelock told the applicant the board would provide a letter of determination within the week authorizing him to contact the Codes Officer to obtain needed permits and begin required next steps. The board included the indoor storage requirement for fertilizer as a condition in addition to its standard conditions for special-use permits; no additional mitigation measures were recorded in the minutes.
The approved permit allows retail sales and service related to landscaping materials at the site. The minutes do not specify proposed hours of operation, employee counts, parking changes, or other operational details; those details will be addressed as part of the building and zoning permit process. The Codes/Zoning Officer (Reay Walker) and town liaison (Darrin Smith) were noted as unable to attend the special meeting; the board advised the applicant to coordinate with the Codes Officer.
