Village Manager Luft and Building Inspector Torres told the board the applicant acknowledged it is noncompliant with Chapter 114 — Flood Damage Prevention — and intends to pursue a variance. "The applicant is aware that they are noncompliant and plan to seek a variance," Manager Luft said. Under Chapter 114 the Board serves as the local administrator for floodplain permits; by code the board must deny the permit so the applicant may appear before the Zoning Board of Appeals.
After discussion a motion to deny the permit was made and seconded; the board voted unanimously to deny the application. The denial does not prevent the applicant from seeking a variance before the Zoning Board of Appeals, which is the next procedural step noted by Village staff.
The board did not provide additional conditions or mitigation requirements as part of the denial; Manager Luft and Building Inspector Torres are expected to provide the applicant with procedural guidance for the Zoning Board process.
