The Town of Clay Town Board on May 18 approved multiple land-use and administrative items, adopted a new local code requirement for smoke shops, and moved several public hearings to future dates.
Key approvals included: - Zone change (Town Board Case #1246) — Sweetheart Corner Redevelopment: Approved a zone change from R-10 One-Family Residential to RC-1 Regional Commercial for property at 102½ Wally Road (+/- 0.35 acres). The board found the action to be an unlisted SEQR action with a completed EAF and determined no significant environmental impact; vote: Ayes 6, Noes 0.
- Special permit (Town Board Case #1247) — Community Bank/Erik Turner: Approved a special permit to allow a bank with drive-thru services at 4000 State Route 31 (+/- 14.9 acres). On a roll-call vote Councilor Courtney Gauthier voted No; Councilors Wisnowski, Young, Bick, Capria and Russell voted Aye. Vote tally: Ayes 5, Noes 1.
- Local Law No. 4 of 2026 (Smoke Shops): Adopted a code amendment adding the term "Smoke Shop" to Town Code Section 230-11C (Terms Defined) and requiring a Town Board special permit to operate smoke shops in HC-1, RC-1 and NC-1 commercial districts. The law explicitly excludes state-licensed cannabis dispensaries. Vote: Ayes 6, Noes 0.
Other approvals and actions: - 2027 CDBG application for Steelway Blvd. South street repairs approved (Ayes 6, Noes 0). - Contract renewal approved for adult crossing-guard services with All City Management Services at $34.80/hour (1,980 hours; not to exceed $68,904) for July 1, 2026–June 30, 2027 (Ayes 6, Noes 0). - Sanitary sewer connection authorized for Scott Merle Builders to tie properties at 4095 and 4101 Elmcrest Road into the Elmcrest Road Sewer District; the developer will pay all construction costs and ongoing Town and County charges (Ayes 6, Noes 0).
Adjourned or continued items: public hearings for several battery energy storage special-permit applications (NexAmp and Carson Power) were adjourned to June 15, 2026; the BESS local law hearing was continued to June 1, 2026. The board also opened and adjourned public hearings on other zone-change applications (Reserve at Clay; Lands of Nelson) for later Planning Board review.
