Bolton commission pursues soil report and negotiation in wetlands enforcement at 37 Notch Road

The Bolton Inland Wetlands Commission discussed enforcement steps for debris and disturbance in wetlands at 37 Notch Road on Nov. 18, with staff and the chair reporting contact with the Town Attorney and outreach to the property owner.
Alyssa Barroso, the wetlands agent, said she and Chair Ross Lally met with the Town Attorney to consider next steps after a letter requesting a soil report was sent to George Logan, the property contact. Barroso said the property owner replied that the scope of work has changed and additional costs are involved, and that the Town Attorney recommended continuing to negotiate with Mr. Logan to obtain the soil report so the property owner can mitigate wetlands issues.
Chair Ross Lally noted the town had previously granted an agricultural exemption for the property but that supporting files cannot be found; he asked staff to notify Town Administrator Jim Rupert about the missing Novus program records and to check with Barbara Kelly on missing documents. The commission did not issue an immediate cease-and-desist order during the meeting and indicated staff will continue negotiations and attempt to secure the required report and mitigation steps.
No formal enforcement order or fine was recorded at the meeting; the commission directed staff to continue discussions with the owner and to report back with the soil report or a mitigation timeline.
