Planning commission approves Superior Construction site plan after resident raises stormwater and setback concerns

The Berkeley County Planning Commission on May 18 approved a detailed site plan for Superior Construction & Hauling to build a 6,000-square-foot maintenance building and paved equipment parking on 2.17 acres on the southeast corner of the Sue Court cul-de-sac.

During the public hearing, Dan Dulyea, a Martinsburg resident and property-owners association president who owns adjacent lots, said the proposed grading and past unpermitted fill have altered drainage and placed additional water onto his parcel. "There is a large amount of water running through a mini storage complex," Dulyea said, and he urged the commission to address what he described as an expanded sliver of runoff and incorrect building restriction lines (BRLs).

Laura Hoffmaster, Deputy Director of Community Development, read the project description and project notes for the commission. Project representative Clint Rock said the single structure complies with the 15-foot building setback for structures and that the small triangular area in question was intended to drain to the stormwater pond. County Engineer Doug Smith said the engineers followed the original drainage design and that the building will drain toward the existing pond.

After discussion and a private meeting request between Dulyea, the engineer and the project representative, the commission closed the hearing and approved the detailed site plan contingent on correcting the setbacks to 15 feet. Commissioner Mike Bush made the motion to approve the Detailed Site Plan with that contingency; the motion carried unanimously.

The commission’s action approves the site plan subject to the setback correction; the project representative and county staff will complete any required revisions and documentation before final permits are issued.
