Commission reviews revised draft data-center ordinance; staff to return final version

Findlay Township planning staff presented a revised draft ordinance on March 24 that would establish regulations for data centers and related accessory uses.
Brandon Stanick said revisions include a provision requiring the acoustical expert for any required sound study to be selected by mutual agreement of the Township and the applicant, with the cost borne by the applicant. He said the draft removes a previously discussed water feasibility study requirement because data centers and accessory uses would be served by public water from the Findlay Township Municipal Authority. The revision also adds a requirement that applicants enter a decommissioning agreement approved by the Township.
Commissioners asked clarifying questions. John Thomas asked whether decibel limits should vary by time of day; Ken Faux suggested keeping a single standard so applicants could pursue variances if necessary. Faux also asked what an applicant would do if no public water or sanitary sewer were available; Stanick said the applicant would be required to build necessary infrastructure. Ernie Leopold asked about fencing and Stanick said chain-link fencing is not permitted unless fully screened by a buffer; Faux noted the ordinance currently allows chain link only if fully screened.
Stanick said he would return a final ordinance for consideration at the next Planning Commission meeting.
