Board staff and Code Compliance noted confusion in the zoning code language. The R2 district's use table lists "nursery schools," and the accessory chart references daycare/nursery with limitations tied to cluster development. Mr. Queenan said the applicant consulted New York State definitions that blur traditional distinctions between "nursery," "preschool," and "daycare," and asked the Board to seek an interpretation from the Zoning Board of Appeals because that determination affects allowable ages and program size.
Traffic consultant Ken Wersted estimated peak trip generation for an 8,000‑square‑foot program at roughly 85–90 trips and said the site has adequate parking for daytime use if church services and daycare activities don't overlap. The Board voted to have counsel prepare referral letters to the ZBA for interpretation and possible variance determination, and asked the applicant to submit the state‑level materials for Code Compliance review.
Next steps: the applicant to provide New York State program definitions and any licensing materials; counsel will prepare the ZBA referral and staff will circulate adjoiner notices.
