The Village of Montebello Planning Board on June 10 approved an amendment to the Weinberger subdivision (Section A) to remove a restriction that previously prohibited basements on Lots 21, 22 and 24.
Applicant representatives, including engineer Rhonda Smith and attorney Paul Baum, presented underdrain and soil-testing reports showing adequate separation from groundwater for the proposed basement floor elevations. The board reviewed Rockland County Department of Planning (RCDP) comments and voted to override recommendations 1, 2, 3, 5, 6 and 7 as inapplicable to this limited modification.
The board adopted Resolution PB04 of 2025 documenting the findings, previous approvals, engineering submissions (including CivilTec underdrain testing) and conditions. The record notes that the lots are part of an approved and filed subdivision (Section A), prior SEQRA review applies, and that certain county reviews will occur during the building-permit stage. Member Marlo Dickman moved to override specified GML comments; Member Joan Materna seconded the motion and it passed unanimously. The board then approved the site-plan modification to permit basements on the three lots.
Engineering materials in the record reported no groundwater at several tested elevations and recommended underdrains for the affected lots. The resolution requires compliance with applicable fees and standard permitting steps during construction.
