Montebello trustees approve amendment to Stonehedge protective zone to allow detention basin

The Village of Montebello Board of Trustees voted to amend a protective zone overlay for the Stonehedge subdivision, allowing a portion of a detention basin on Lot 12 to intrude into the Fant Farm protective zone.
The change, approved by Resolution 25-107, follows a coordinated review in which the Planning Board on Sept. 9 issued a Negative Declaration under SEQRA conditioned on specified site-plan limitations and screening. The board approved the resolution on a roll call vote: Deputy Mayor Stacy Caridi — Approve; Trustee Michael Humphrey — Approve; Trustee Bruce Egenhauser — Approve; Trustee David Rose — Nay; Mayor Lance N. Millman — Approve. Trustee Egenhauser moved the motion; Deputy Mayor Caridi seconded.
Mayor Lance N. Millman explained the procedural sequence the application followed through local boards and said the change is largely a technical step to align the protective-zone map with the Planning Board’s site plan.
Deputy Village Attorney Terhune and Village Attorney Warren E. Berbit described the SEQRA process and the effect of the Planning Board’s Negative Declaration. As Berbit confirmed during discussion, “a ‘Neg Dec’ is really a positive, meaning no adverse environmental impact.”
Trustee David Rose asked for additional explanation of what a Negative Declaration involves and why the detention pond may be moved; the mayor and attorneys responded with a summary of the coordinated environmental review and the conditions required by the Planning Board and the Historic Preservation and Parks Commission.
The trustees’ action adopts the Planning Board’s conditions and allows the detention basin adjustment as set forth in the Planning Board resolution and map. No separate vote on site-plan conditions was recorded at the Board meeting.
The project will proceed subject to the Planning Board’s conditions and any final action by the Historic Preservation and Parks Commission.
