Finance committee reviews fee overhaul, local option for fee setting and enforcement changes

Town staff presented Articles 16, 17 and 19 as a coordinated effort to modernize Arlington’s fee structure and to improve collection for unpaid noncriminal dispositions.
The staff presentation explained Article 16 would update Title 9 Article 3 to incorporate missing fees, reflect fees that have been charged in practice, and add modest increases to many permit and license categories. "We would expect this to generate on the order of magnitude of at least an additional $100,000 annually in revenue," the Town manager said.
Article 17 would adopt a local option provision (cited in the discussion as chapter 40 §22F) to allow municipal boards or officers empowered to issue permits or licenses to set and amend associated fees, subject to manager and Select Board approval. Staff said the article seeks to remove ambiguity about the town’s prior acceptance of that local option.
Under Article 19, the town would expand the list of noncriminal disposition violations that can be placed on a property’s tax bill if unpaid. Staff framed the change as a practical way to capture low‑value citations (for example, leaf blower or dog leash violations) that historically did not get paid and for which court enforcement was disproportionately costly.
Committee members pressed staff on implementation and fairness: how increases would be sized, whether building‑permit fees (which the town said already operate on a value‑of‑construction formula) would be touched (they would not), and whether nonresident property owners could be pursued. Staff said a full schedule of proposed fee amounts would be circulated to the committee in advance of Town Meeting and that options to add administrative permit fees could be considered.
Members also raised equity and appeal concerns for future fee‑setting under Article 17; staff described administrative appeal avenues, clerk‑magistrate appeals for citations, and the potential for court challenges to municipal fees should residents object to reasonableness.
No vote was taken at the meeting; the committee asked staff to circulate the full fee schedule and supporting cost analyses ahead of the Town Meeting discussion.
