Osceola council approves ordinance to vacate alley in Atkins Addition

The Osceola City Council on July 1 adopted an ordinance to vacate and convey the west half of the east/west alley in Block 7 of the Atkins Addition.

Council member George Fotiadis moved to approve the second reading of the ordinance; José Vargas seconded. The council voted unanimously to approve the second reading and then, on a subsequent motion by Thomas Bahls seconded by Sonya Hicks, voted to waive the third reading, allowing the ordinance language to be entered into the record as Ordinance 684.

Ordinance 684 states the city finds the described alley is not needed for public use, is not presently open, and that vacating it would better serve adjoining landowners while preserving reasonable access for abutters. The ordinance also directs that any quitclaim deeds executed after the ordinance’s effective date will be presumed valid, and it expressly preserves a perpetual city easement for municipal and franchise utilities and snow storage.

The action transfers authority to convey the vacated area to adjacent property owners by quitclaim deed; the ordinance text in the record does not list purchasers or sale prices. The council did not record any objections filed with the city before the hearing, and the ordinance notes that notice of the intended vacation was published as required.

The council’s vote on the ordinance was recorded as five ayes (George Fotiadis, José Vargas, Thomas Bahls, Luci Sullivan, Sonya Hicks); the motion carried. The city clerk was directed to process the conveyance documents per the ordinance provisions.

The ordinance passage was taken as a formal action during the July 1 meeting; the council also approved related procedural motions to complete the reading and recordation process.
