Michael McGean, speaking to the Board, said the total settlement amount is $179,470.18 and that any retained properties would have to be listed for auction within three months of the settlement being signed, with any proceeds directed into the settlement fund. "Any retained properties will be listed for auction within three months and auction proceeds will be paid into the settlement fund," McGean said.
Commissioner Kit Johnston moved approval of the settlement; Commissioners Johnston, Mary Starrett and David "Bubba" King voted aye. The motion passed unanimously.
The County record indicates that two properties previously donated to the Housing Authority of Yamhill County were considered sold and were included in the settlement total, McGean said. The settlement is subject to court approval under Federal Rule of Civil Procedure 23, according to the staff report.
The Board took the vote as part of its "Other Business" agenda; the minutes record the Board’s action and set the payment deadline as June 2026. The next procedural step listed in the meeting record is submission of the signed settlement for court approval.
