Boscawen planning board conditionally approves five-year excavation permit for Sled Road LLC

Acting Chair Barbara Randall presided as the Town of Boscawen Planning Board voted unanimously on June 2 to conditionally approve a Minor Site Plan and a five-year excavation permit for Sled Road, LLC, for property at 51–57 Commercial Street (Map 183D, Lots 133, 134 and 147).
The board accepted the application as complete after PCD Coordinator Tanya Decato confirmed submission requirements were met and Ex-Officio Josh Crawford moved to accept completeness. The public hearing was opened at 6:43 p.m.; Cynthia Theriault of Wilcox & Barton represented the applicant and explained that the prior excavation permit and the site's Alteration of Terrain (AoT) permit had expired in March 2025, that an updated AoT has been received, and that the plan is to continue to use the pit for excavation until the lot is developed. No abutters or members of the public attended the hearing.
The board granted a waiver to treat the filing as a Minor Site Plan (motion by Carli Walsh, second by Gary Tillman), citing a Code Enforcement determination letter. Following discussion, Gary Tillman moved to conditionally approve the application; Carli Walsh seconded. The motion passed with all members present voting in favor.
The board attached 12 conditions to the approval, including: a reclamation bond; annual review by the town engineer; conditions incorporated on the final plan; all required state and local permits; revising the excavation area to ensure compliance with RSA 155:E.2.II (the expressed minimal standards requiring excavation areas to be 150 feet from existing buildings); professional stamps and owner signatures on final plans; providing the 1997 NHDES site-specific permit number on the final plan; adding notation on the plan regarding wetlands presence; recording any waivers and conditions on the final plan; recording the Notice of Decision at the Merrimack County Registry of Deeds if the plans cannot be recorded; a required response from the engineer to Underwood Engineers’ review comments; and listing the current Alteration of Terrain permit number on the final plan.
After the approval motion, Ms. Walsh moved and Mr. Tillman seconded an amendment to set the excavation permit’s new expiration date as March 2030; the amendment was approved unanimously.
The board instructed that Underwood Engineers' comments be addressed as a condition of approval and that the final plan include all waivers and required permit numbers before recording. The planning board scheduled its next meeting for July 7, 2026, at 6:30 p.m. and adjourned at 7:21 p.m.
Formal actions recorded at the meeting include the waiver approving a Minor Site Plan in lieu of a Major Site Plan and the conditional approval of the five-year excavation permit for Sled Road, LLC, as described above.
